浅谈“亲亲相隐”入律的合理性

亲亲相隐是中国古代法一直遵循的一项基本原则,体现了中国特有的宗法制度和人伦情怀。然而及至近代,在对西法的移植过程中,中国逐渐抛弃了这种几千年来一脉相承的法律思想,严重背弃了传统和中国特有的法文化,使得一部分的立法和法律实施得不到民众的认同,长此以往,对社会主义法治势必造成负面影响,因此,"亲亲相隐"入律符合中国法律的传统和实际,体现了对人性的关怀和保护,符合我国法制改革的初衷。在《刑法修正案八》征询意见之际,以期立法者能够看到"亲亲相隐"思想的合理之处。

Concealing between the relatives has been followed a basic principle by Chinese ancient law,which reflects the unique Chinese patriarchal system and ethical feelings.However in modern times,in the process transplanting western law,China was gradually abandoned thousand years legal thoughts,which seriously receded from traditional and special Chinese legal culture.In this condition,part of the legislation and law enforcement get people's attention.And in the long run,this kind of situation would cause negative effects to socialist legal system.So,putting the thought of concealing between the relatives into law will comply with Chinese law tradition,reflect on humanity and care and protection,conform to the criminial law,hope that lawmakers see the reasonable place of this thought.
