在世界范围内,无论是英美法系国家,还是许多大陆法系国家,都存在行政判例制度。我国法律不承认行政判例的约束力。在中国,为弥补制定法的缺陷,回应权利需求和保证司法统一,有效地预防与控制行政自由裁量权的滥用,是构建行政判例法的必要性。

In the world,both the common law countries and many civil law countries have the system of administrative case.China does not recognize the binding effect of the administrative case.In China,to make up for the defects of the constitutional law,respond to the needs of right and guarantee the judicial unity,effectively preventing and controlling the abuse of the administrative discretion,is the need for the establishment of the administrative case law.
