摘要
"监管"是现代国家为了应对市场失灵而发展出的政府治理模式。在监管国家的背景下,行政法解释权的分配以及解释的"背景规范"也产生了相应的变化。美国背景规范转变理论的社会、政治环境与中国迥异,不宜直接适用,但是其精神却值得借鉴:利用政府反映民主,增进个人自治、福利与平等,并且下放权力,保障市场的灵活性、适应性与生产潜能,最大限度地实现监管国家的治理效果。
Regulation is a model of governance for government in modern states to response to market failure.In such context of regulatory,the distribution of administrative interpretation and the 'background norms' of interpretation also changed correspondingly.The conversion of background norms in America is quite dissimilar with China;therefore,it is not proper to be used directly.Yet the spirit of such norms is worth to use for reference,which ask government to improve democracy,personal autonomous,welfare and equality,meanwhile to reduce its power,ensure the flexibility of market,and to improve adaptation and the potential of production to maximize the governance effect.
