诉讼证明活动中的首要的是解决有关证明责任问题,它是对诉讼证明本体结构进行分析的突破口。不同的责任就意味活动主体的不同角色,参与诉讼证明活动的主体可分为两类:主动主体和被动主体,实际上这依然是责任问题的延展;任何参与到诉讼证明活动中来的主体都是在围绕"事实主张"进行活动,这就更加突出主动主体在诉讼证明活动中的"主动"地位;依据这种责任和主体的区分,可将一般意义上的诉讼证明标准解构为证明要求和认定标准。

The primary problem need to be solved in lawsuit testimony is the responsibility of proof,it is a breakthrough to analyze the lawsuit testimony ontological structure: different responsibility means different roles of subject,the subject who take part in the lawsuit testimony activity can be divided in two categories: active subject and passive subject,actually,it is the extension of testimony responsibility;Any subject to participate in lawsuit activity all around 'factual claims' to carry out behavior,this is more highlight the active role of active subject in lawsuit testimony;According to this distinction about responsibility and subject,the lawsuit testimony principle general can be divided into testimony requirements and identify standard.
