网络民意:魔鬼与天使——以司法为例透析网络民意的法律意义

Public Opinion of Network: Devil and Angel——To Elaborate the Legal Meaning of Public Opinion of Network with the Example of Justice

随着网络基础设施逐步完善、群众参与程度越来越高,互联网为公民的言论自由这一宪法性权利提供了前所未有的广阔发展空间。网络民意因为内涵丰富,对社会现实和人们生活息息相关,涉及多个学科领域。网络民意作为普通民意表达最直接最"原汁原味"的方式,受到了网民极大的欢迎,也受到了政府部门的高度肯定。但是,不同于立法、行政等活动,司法由于其本身功能和性质的特殊性,使得网络民意对司法的意义较其他领域更为有限,司法应当对网络民意有较高的免疫力。

From the perspective of justice,this article distinguished public opinion of network from general public opinion,justice from general public activities.With the combination of the characteristics of public opinion of network and the nature of judicial activities,it elaborated both the positive and negative impact public opinion of network made on justice,especially the possible deeply negative impact on our legal construction,in order to remind people of a more rational attitude towards public opinion of network in the field of justice.
