减刑是我国刑法中一项非常重要的刑罚执行制度,是罪刑相适应原则在刑罚执行中的体现,在司法实践中被广泛应用,产生了良好的社会效益。但减刑的根本条件存在明显的缺陷和不足,从而影响了减刑功能的发挥。因此,必须对减刑的根本条件进行重构,使减刑制度发挥出最佳的效益。

Commutation is a very important penalty of Chinese Criminal Law.In judicial practice,it is widely used to produce good social benefits.However,there are obvious flaws and shortcomings,which affect the functions of commutation in the fundamental condition of commutation.Therefore,the fundamental conditions of commutation must be reconstructed,in order to play the best results of Commutation System.
