浅析“畜产咬踢人”律

动物致人损害是一种特殊的侵权行为,虽然现有法律规定是源于西方的,但是我国清代即有相似的法律:"畜产咬踢人"。该律对动物致人损害作了详细的规定,由于该律是将侵权行为法规范夹杂在刑法规范之中的,与现代法律体系不符,所以未被采用,但是该律因承袭了中国自古以来关于动物致人损害的法律规定与传统,确有可借鉴之处。

Damage caused by animals is a special kind of tort,although the existing law is derived from the West,but that is similar to China's Qing Dynasty law: 'Livestock bite or kick human'.The law of the damage caused to the animals in detail the provisions,as the law of tort law is to standardize the norms of inclusion in the criminal law,and inconsistent with the modern legal system,it has not been used,but the law followed Chinese ancient law on animals causing damage to the legal provisions and traditions,can actually be made of the draw.
