论中国国家赔偿法的不足与完善

On the Deficiency and Consummation of China's State Compensation Law

国家赔偿法作为一部在行政权力下保障公民合法权利的重要法律,其重要性在法制不断完善的今天是不言而喻的——我国的国家赔偿法自然也不例外。然而,我国国家赔偿法从生效至今,其地位却从千呼万唤变成了令众人失望。界定国家赔偿法的基本概念,针对目前我国国家赔偿法的基本状况,提出国家赔偿制度的完善意见以及国家补偿制度对国家赔偿制度的弥补作用具有重要现实意义。

The state compensation law as an administrative authority in the legal rights of citizens under the protection of important laws,the importance of continuous improvement in the legal system today is self-evident-China's State Compensation Law is no exception.However,China's State Compensation Law from the commencement date,its status but never repeated calls to make everyone into a disappointment.This paper described our basic concept of the State Compensation Law; the second part of the basic conditions in China; third part of the progressive for its lack of a complete set of views; fourth part described the state compensation system up to the state compensation system.
