Legal Protection for Interactions between Parties in the Course of Environmental Protection

法律对于环保事业主体良性互动关系的保障程度,是衡量一个国家的环保事业和环境法制发展水平的重要指标。本文结合《环保法》修订研究工作的成果,提出并论述"环保主体互动关系"概念和"环保主体互动等边三角形模型"的研究方法,介绍外国在环保主体互动关系方面的经验和教训,论述环保事业中的管制和监督两类互动关系的理由和原理,就完善法律对于环保主体互动关系的保障提出了比较系统的制度设计。

The level of legal protection for interactions between parties in the course of environmental protection is an important indicator for evaluating the levels of development of environmental protection and environmental legal system.This paper proposes and elaborates on the concept of 'relationship and interactions between parties in environmental protection',introduces experience and lessons from other countries in this regard,elaborates the reasons and principles for environmental regulation and supervision,and expounds on a systematic system design for protecting the interactions between parties in environmental protection in China.
