论法院在我国环保事业中的法律地位和作用

Legal Roles of Courts in Environmental Protection in China

行政失效和司法失效是导致当前中国"行动中的环境法"脱离"文本中的环境法"的两个主要原因。目前法院在我国环保事业中扮演着有限的角色。有限、脱节甚或矛盾的法律文本也限制着法院的作用。在环境司法中确认和拓展公民及其团体的权利,规范和约束地方政府及其部门的权力,可能是发挥法院在我国环保事业中的应有作用的可行路径,也是建设社会主义法治国家的重要一环。

Defective administration and adjudication are responsible for making 'environmental protection law in action' different from 'environmental protection law in books' in current China.The courts are playing a very limited role in environmental protection.Limited,old-fashioned or even contradictory laws and regulations also limit the role of courts.To guarantee the rights of citizens and organizations and to delimit the powers of local governments and their departments in environmental adjudication is an alternative way for courts to play their proper roles in environmental protection and is a vital element for China to construct a socialist state that is ruled by law.
