On the Perfection of Legislations on Crime of Dereliction of Duty for Food Supervision

食品监管渎职罪存在立法缺陷:罪状的描述不够严谨、立案标准过高、刑罚设置不合理,建议完善食品监管渎职罪的立法:以司法解释形式完善罪状的描述、降低立案标准、合理设置刑罚。

The events of violating Food Safety Law tend to appear frequently,which leads to the worries of citizens about the food safety environment and also discloses the deficiency of food safety supervision duty of relevant administrative departments.Criminal Law Amendment(8) adds dereliction of duty for food supervision as a crime.The establishment of crime of dereliction of duty for food supervision adapts to the requirement of our government's focus on people's livelihood and reflects government's emphasis on food security and determination in combating crimes of food safety.This paper introduces the concept of crime of dereliction of duty for food supervision and its legislative significance,analyzes its constitution and points out its defects in legislation.
