微博新媒体时代,不仅出现了言论自由、信息自由、公民参与新的情况,而且也提出了国家依法管理社会、维护公共利益的新要求。既要保障宪法关于国家尊重和保障公民言论自由、信息自由、批评与建议权等权利的原则,也要提高国家维护信息安全流通、保障个人隐私、商业秘密和国家安全的职责。尤其要适应微博发展带来的信息流通安全的客观情况,采取有效措施,防止微博带来的社会管理新问题,适应保障信息安全流通的新情况,畅通、利用微博新媒体表达民意的新渠道,创新网络信息流通与信息管理的新方法。

The development of micro-blog has realized citizen's basic constitutional authority,meanwhile,led to the requirement of information management and social administration as per the law.It should be achieved to respect and guarantee the freedom of speech,freedom of information,criticism,suggestions,and constitutional basic rights.It should be realized to improve the ability of safe information circulation and take the necessary measures to protect personal privacy, commercial secrets,and national security.In particular,for the objective circumstances of information flow security brought by the development of micro-blog,effective measures should be taken to prevent the new issue brought by microblog, adapt to the new situation of information security in circulation,expedite the new channel of expressing the public opinion,and innovate the new method of network information security and information circulation.
