Study on Law Application of Gambling Debt

赌债是赌博带来的社会问题,本文引入债的法律关系对其予以分析,厘清赌债法律性质,从实证法角度分析解决赌债纠纷案件的事实认定问题,提出如何解决此类特殊纠纷的证明责任分配问题,并就此类问题涉及的债与非债、合法之债与非法之债、个人之债与共同之债提出区分认定见解,从权利平衡角度提出了此类纠纷的适用法律意见。

Gambling debt is a social problem because of gambling.In this article,author tries to analyze the issue using the theory of legal relationships on credit,distinguish the characters about gambling debt,analyze the problem of recognizing facts in resolving those cases from the positivism of law,solve the special dispute how to assign the burden of proof,put forward views on how to distinguish debt and off-debt,legal and illegal debt,individual debt and a common debt,and propose the law application to such trouble from the angle of rights balance.
