浅论我国违宪审查制度的模式选择

On the Pattern Options of the Unconstitutional Censorship of China

我国目前形成了以最高国家权力机关为主体,其他国家机关相配合的违宪监督体制,但纵观普通司法机关和专门机关的违宪监督各有弊端,我国的违宪审查制度因其自身没有通过法律的明确规定而显得发展和讨论的空间非常大。在目前世界上存在的违宪审查模式中,采用独立的宪法法院模式是我国最佳选择。

At present the unconstitutional censorship has been established which is the supreme organ of power and is integrated with other state organs.However,there also exist some disadvantages in the unconstitutional supervision in general and specific judicial authorities.The Chinese unconstitutional censorship has a large space to discuss and develop because it hasn't been regulated by law.Now among the unconstitutional censorship patterns in the world,the independent Constitutional court is the best choice in China.
