我国民间手工艺品知识产权法律保护研究

A Study of Legal Protection of Intellectual Property to Chinese Folk Crafts

民间手工艺品是我国的物质文化遗产,对民间手工艺品进行保护已成为法学界尤其是知识产权法学界许多学者的共识。但是,民间手工艺品知识产权保护、民间手工艺品权属确定、知识产权法律保护等等问题亟待解决。本文拟就民间手工艺品界定、民间手工艺品知识产权保护、基础以及民间手工艺品的知识产权法律保护建议等几个问题展开论述。

Fold crafts is the cultural heritage in China. The protection to folk crafts has become common sense among scholars in law circle,especially in intellectual property law circle. However,problems including the protection of intellectual property to Chinese folk crafts,the confirmation of its right and the legal protection to intellectual property,etc,is to solved urgently. This paper elaborates the issues of defining,the protection of intellectual property to folk crafts,the basis and suggestions,etc.
