对行政诉讼第三人有关问题的研究

A Study of the Relevant Issues of the Third Party to Administrative Litigation

自行政诉讼法实施以来,行政诉讼第三人的适用体现出其独特的价值,起到不可或缺的作用。但是该问题一直存在较多争议,成为法学界和审判实践关注的热点、难点。笔者就行政诉讼第三人的概念、特征,存在问题及完善意义进行了论述,并就如何完善行政诉讼第三人制度提出了自己的几点建议。

Since the implementing of Administrative Litigation,the application of the third party to Administrative Litigation has displayed unique value and played an indispensable role. However,this issue has been argued and become a heat and difficult point in law circle and judicial practice. This paper elaborates the definition,features,existed problems and significance of it,furthermore,puts forward suggestions on to to perfect this system.
