摘要
本文通过对《设备监理合同(示范文本)》和《设备工程监理服务合同范本(试行稿)》的比较分析,解读了《设备监理合同(示范文本)》的主要修订内容。在此基础上,明确了生效时间、权利义务和违约责任等规范内容,深化了专业监理、意思自治和合同纠纷等创新内容。研究表明,《设备监理合同(示范文本)》对完善合同管理体制、促进设备监理行业发展具有重要意义。
The present research paper, through a comparative analysis of Plant Engineering Consulting Contract (Demonstration Version) and Sample Text for Plant Engineering Consulting Service (Trial) , explains the major revisions on Plant Engineering Consulting Contract (Demonstration Version). On this basis, it defines such standardization contents as the effective date, rights and obligations and liability for breaching contract, etc., and emphasizes such innovative contents as professional consulting, autonomy and equipment supervision contract disputes, etc. Studies show that Plant Engineering Consulting Contract (Demonstration Version) has great significance on improving contract management system and promoting the development of plant engineering consulting industry.
