摘要
随着社会的发展,在校大学生勤工助学的现象越来越普遍,其积极作用自不待言。但在勤工助学活动中,大学生权益受侵害的情况屡有发生,且呈上升趋势。究其原因,在法律层面,除了大学生自身的事前防范、事后维权意识不强之外,立法的滞后及由此带来的法律法规的缺失也是不容忽视的。无论是部门规章、《劳动法》还是《劳动合同法》,均未把勤工助学的大学生作为其规范的对象,这对大学生勤工助学权益的保护非常不利。
With the development of society,College Students Work-study phenomenon has become more and more common.Though it works positively,college students' infringement cases increase for the reason that the lag of legislation results in under-developed laws in addition to undergraduates' little awareness of self-protection and laws.Mainly,neither employers' regulations,Labour Law nor Labor Contract Law provide related legal rights for work-study students,which is not helpful to protect work-study students' interests.Herein,the author tries to find a solution to the problem in order to change this situation.
