著作权侵权与犯罪,是著作权保护中常见的术语。著作权侵权是民法评价的结果,著作权犯罪是刑法评价的结果。在实践中,侵犯著作权有许多新的方式,诸如以第一版的内容冒充第二版出版,侵犯了作者的修改权,出版社未经作者许可,许可他人印制,故意侵犯保护作品完整权和作者的人格权,侵权图书数量问题难以统计,使用旧书号,等等。侵犯著作权罪是在侵权的基础上违法所得数额较大或者有其他严重情节的行为。著作权犯罪就是在著作权侵权基础上进行的刑法评价的结果。

In practice,copyright infringement has many new ways,such as with the first edition's content as the second edition to publish,violates the author's amended right,the presses without the author's permission, permit others to printed,willful infringe the protection works integrity right and personality right,the quantity of infringed books are difficult to statistics,using old ISBN etc.Crime of copyright infringement is a large amount of illegal income or other serious circumstances behavior on the basis of infringement.Crime of copyright infringement is a crime evaluation results on the basis of criminal law.
