公安机关实施新《刑事诉讼法》面临的问题与对策

Problems and Countermeasures in Implemerting the New Criminal Procedure Law by the Police

新《刑事诉讼法》即将生效,而目前公安机关还存在着执法理念不能适应新《刑事诉讼法》要求、刑事技术力量不足、科技强侦投入不够、民警科技取证能力不强等客观困难。公安机关应理性对待刑诉法修改,正视面临的问题,主动更新执法理念、转变传统侦查模式、完善执法制度、加强执法管理监督,多措并举提高侦查取证水平,积极应对挑战。

The new Criminal Procedure Law passed on March 14,2102 is going to take effect,but problems still exist in the public security organs,for example,the concept of law enforcement does not fit for the new act,the criminal force is not strong enough,the fund for technology is not rich enough,the ability of taking evidence is not better enough and the justice interpretation and the executing system need to be set down.The police should treat the new act with nous by envisaging the problems,renovating the executing ideas,changing the traditional criminal investigation model,perfecting the executing system and strengthening the supervision.All in all,the police should take multi-measures to answer the challenge.
