论公安行政处罚自由裁量的内部规制

On the Internal Regulation of the Discretionary Power of Public Security Administrative Punishments

行政处罚自由裁量是法治社会的必然要求,也是公安执法活动的客观需要。为实现裁量正义,公安机关应当主动作为,从自我约束的角度实行内部控制,通过优化组织结构、提高执法素质、细化裁量标准、强化行政程序、完善复议机制、加强监督制约等一系列内部行政制度建设,达到规制行政处罚裁量、促进警民和谐的社会效果。

The discretionary power of public security administrative punishments is both an integral part of developing a society ruled by law and a necessary requirement of conducting public security activities.To achieve justice of the administrative discretion,public security organs should take the initiative to implement internal regulation based on self-discipline and construct a series of internal administrative systems including the optimization of organizational structure,the improvement of administrative quality,the refinement of discretionary standards,the enhancement of the execution of administrative procedures,the consummation of the reconsideration mechanism and the strengthening of internal supervision.In doing so,the social effects of properly regulating the discretionary power of public security administrative punishments and building a harmonious relationship between public security organs and people will be produced.
