仲裁中立原则要求仲裁庭必须平等对待双方当事人。中立原则的绝对化会导致简单的形式正义,但可能会对实际力量不对等的仲裁当事人产生实质不公。当事人之间事实上的力量失衡,要求国际体育仲裁院(CAS)必须进行衡平救济,在人事安排、经济援助和庭审技术等方面进行实质正义的衡平考虑。仲裁实例作为"活的法律",为CAS的衡平仲裁提供了生动的考察样本。

The impartiality principle in arbitration requires arbitral tribunal treat parties neutrally.The absoluteness of impartiality principle will lead to simply formal justice,but it may bring material injustice to parties to arbitration whom have unequal strength.That calls for CAS to take equitable remedies such as rearrangement of human resource,economic aid,and tribunal technique for parties.The cases in arbitration as 'living law' make it possibility to examine the equitable remedy of CAS.
