把法律作为修辞——讲法说理的意义及其艺术

Law as Rhetoric

法律人应该把法律作为修辞,强化法律思维过程的讲法说理功能。法学原本与修辞学同根同源,因而我们应该在重视法律解释、推理方法的同时,把法律本身作为修辞论辩的工具。法学研究应该为不断地提升法律论辩、论证能力而作积极的准备,这是我国法治建设所不可缺少的。把法律作为修辞,融推理、解释方法和修辞论辩方法于一身,把合法性和合理性结合起来,对促进我国的法治建设有十分重要的意义。

Law people should regard law as rhetoric,strengthening the function of legal argumentation in legal thinking.Jurisprudence and rhetoric share the same root,so we should use law per se as a rhetorical tool in the argumentation while emphasizing the legal interpretation and legal reasoning.The research of jurisprudence should continue to advance the capability of legal artumentation,and this is indispensable in Chinese legal construction.It is of great significance for promoting Chinese legal construction to regard law as rhetoric,combine reasoning,interpretation,and argumentation in one,and linking legitimacy with rationality.
