试论医疗纠纷的调处和防范与构建和谐社会的关系

医疗纠纷不仅仅是一个十分重要的公共卫生问题,且与构建和谐社会密切相关。目前,我国的医疗纠纷不断增多,调处难度增大,已引起医药卫生、司法系统、行政部门以及社会上的广泛关注。因此,及时有效地调解处理好各种医疗纠纷,并最大限度地防范医疗纠纷的发生,是解决医疗纠纷这一特殊矛盾,维护安定团结,构建和谐社会的一个十分重要的内容。笔者认为,在调处方面,首先要查明事实,对涉及死亡的医疗纠纷案例要尽早做尸体解剖,以查明死因、分清责任;其次是根据事实,依法调处;同时要做好说服解释工作,力求和谐。在防范方面,健全的法制、完善的规章制度是减少和调处好医疗纠纷的重要保证,医、患双方良好的道德和文化素质是避免发生医疗纠纷并易调处的重要因素;加强医院的科学管理是防范医疗事故的关键,增强医护人员的工作责任心,提高专业技术水平和服务质量,是防范医疗事故的根本。

At present, the medical tangle in our country increases continually and its mediation become more and more difficulty, which has caused the widespread attention in the field of medicine and health, the judicial organizations and the national administrative departments. Therefore, mediating and handling various kinds of medical tangles timely and effectively and preventing it from occurrence without limit is one of important contents to solve this special contradiction of medical tangle, to maintain social stability and unity, and to construct the harmonious society. At the aspect of mediation of medical tangle: Firstly, it is necessary to make the fact clear. Autopsy must be done as soon as possible if the patient died in order to ascertain the cause of death and distinguish the fact and correspondence responsibility. Next, it must be mediated legally according to the fact,and at the same time, the work of persuasion and explanation should be done well so as to strive to be harmony among them. About the prevention of medical tangle: The perfect legal system and the complete rules and regulations are the important guarantee to reduce and medicate the medical tangle. A good moral and cultural quality of both sides of the medical staff and patient are the important factors to avoid occurrence of the medical tangles and to treat it easily. To strengthen the scientific management to the hospital is the key to prevent the medical malpractice. To raise the sense of responsibility of medical workers and improve the professional technical level and medical service are the basis to prevent medical malpractice.
