我国自然保护地居民权利保障法律制度研究

Research on Legal System of Right Protection of Residents of Nature Reserves in China

自然保护地的建立有利于防止生态系统退化,保护和维持生物多样性。我国自然保护地建设事业在取得显著成效的同时,保护地居民的使用权、财产权、人身权、文化权利却没有得到切实保障,这与法律制度的不完备有密切关系。当前,在我国自然保护地居民权利保障上存在管理体制不清晰、居民参与机制不健全、补偿机制不明确、利益分享机制不完备等问题。为切实保障我国自然保护地居民的权利,必须加强我国相关立法,以理顺管理体制,健全居民参与机制,完善损失补偿机制,建立利益分享机制等。

The establishment of nature reserves is favorable for preventing the degradation of ecosystems,protecting and maintaining biological diver sity.However,even though the establishment of nature reserves achieves remarkable results in China,use rights,property rights,personal rights,cultural rights of conservation residents have not been effectively guaranteed,which is closely related to the incompleteness of the legal system.Nowadays,there are a lot of problems on the protection of the rights of conservation residents,such as the imperfect management system and participation mechanism,uncertain compensation system,and incomplete benefit-sharing mechanism.To protect rights of conservation residents,relevant legislation must be strengthened to solve the problems.
