The Liberalization of Trade in Legal Services in the European Union

贸易自由化是欧盟经济与货币同盟的重要内容。在欧盟服务贸易自由化机制的推动下 ,律师服务同欧盟其它众多的服务行业一样 ,在自由化方面取得了重大成果。《律师服务指令》、《文凭指令》和《永久执业指令》,以及一系列欧共体法院判例 ,基本上扫除了成员国律师在其他成员国境内临时性或永久性自由提供服务的障碍。欧盟的这一成果 ,预示着法律服务贸易自由化在 WTO等国际经济组织的推动下 ,在全球范围内发展的趋势。

Trade liberalization is one of the most important economic policies of the European Union. With the promoting the legal system for liberalization, the EU has made a great achievement in the trade liberalization in legal services in the union, like any other service sector. Lawyers' Services Directive, Diploma Directive and Permanent Establishment Directive, together with a series of cases of the European Community Court, have swept out barriers to the freedom of supplying legal services and establishment by lawyers of one country member in other countries member temporarily or permanently by and large. The achievement of the EU prefigures the trend of development of the liberalization of trade in legal services in global areas with the facilitation of the WTO and other international economic organizations.
