摘要
传统社会强调人与人之间的等级差别和人身依附,现代社会强调以人为本和法律面前人人平等。劳动是平等主体的民事活动,劳动权是民法赋予公民的民事权利。权利义务的平等性和统一性要求劳动关系是平等主体间的合同关系,市场经济和社会转型也要求企业与劳动者之间建立平等的劳动关系。为改变劳动者与企业之间的隶属关系和依附关系,确立平等劳动关系,平衡劳动者和企业双方的权利义务,有必要把劳动关系纳入民法典的调整范畴。
Traditional society relied on status difference and personal dependence between people.Modern society puts people foremost and stresses the equality of all people under law.Labor is a civil activity of equal citizens.Citizens get the right to work form the civil law.The equality and unity of rights and obligations demand that the relationship between equal citizens be that of contract.Market economy and social transformation also require that equal labor relationship be established between employer and employees.In order to change laborer’s subordination to and dependence on employers and establish equal rights and obligations between workers and enterprises,it is necessary to place labor relations under the adjustment of the civil code.
