司法独立原则在中西方的体现

司法独立原则是由西方资产阶级启蒙思想家所提出,是构建建立法治社会的基石,现已成为国际社会普遍认可的一项法治原则。中国特殊的国情就决定了中国的司法独立原则与西方的存在着较大差异。文章通过对中西方司法独立原则进行介绍从而对比其中存在的差异,以及我国司法独立对实行宪政建设将会带来的影响。

Principle of judicial independence were put forward by western enlightenment thinkers,which was the basis of nomocracy construction and a item of principle of law universally accepted by countries.The actual condition of China make the differences in Judicial independence between China and western countries.This article mainly makes introduction of Judicial independence in western and Chinese legal system,compares their differences and discusses the influence of Chinese Judicial independence on construction of constitution.
