政府采购中供应商资格审查制度探究

供应商是政府采购法律关系中的重要当事人之一,对供应商资格进行审查,可以促进供应商之间公平竞争,有效约束政府采购行为,提高采购效率,更好地保护采购双方当事人的合法利益。我国《政府采购法》对供应商的资格审查做出了相应规定,但较为笼统且可操作性差。应当从供应商资格审查主体、审查内容及审查程序等方面进行相应完善,以保障政府采购活动的顺利进行。

The supplier is important parties of the government procurement law relationship,supplier qualification can promote the fair competition among suppliers,restrain the government procurement behavior effectively,improve procurement efficiency,ensure the legitimate rights and interests of both parties.Although the government procurement law formulates the system of supplier qualification examination,but the legislation is too general to execute.In order to ensure the government procurement activities carried out smoothly,the supplier qualification examination system must be perfected by analyzing subjects,contents and procedure of the supplier qualification examination.
