完善我国公共危机管理法律体系研究

A Research on Improving System of Laws of Our Country’s Public Crisis Management

建国以来,频繁的应急管理实践使我国政府在处置突发公共事件方面积累了一定的经验,也相应地制定了大量的法律、法规、部门规章等法律文件,初步形成了能够覆盖各个层面的的危机管理体系;但由于立法主体的多元化特点,在法律体系的建立方面缺少宏观统领,立法者之间缺乏沟通与协调,许多法律文件彼此独立、交叉重复、相互冲突,许多规定操作性较差,危机管理部门比较分散,等等,这严重影响到我国公共危机管理法律体系的科学性与实效性。因此,针对这些问题,各级权力机构、行政部门应在其职责和职权范围内,遵照统一的立法宗旨,按照不同的立法要求,针对不同的危机类型,制定和修改相应的法律、法规与规章,使我国的公共危机管理法律体系臻于完善,在保障社会稳定、经济建设、人民生命财产安全方面发挥更大的作用。

Through frequent emergency management practices,our government has accumulated certain experience in public emergency disposal and accordingly a large number of laws,regulations,department regulations and other legal documents have been formulated and the crisis management system of which cover all aspects has been initially formed.Due to the diversity subject of legislation,the system there are some defect in the system,many legal documents are independent,obliquitous,repetitive,conflicting.Many rules are lack of operability.The departments of crisis management are more dispersed,and so on.These problems have a strong impact on scientific nature and effectiveness of the legal system.Therefore,aiming at these problem,directing at different kind of crisis,according to unitive purpose of legislation and the different legislative requirements,all levels organ power,administrative department should work out relevant laws,regulations,which perfecting our country's public crisis management legal system,ensuring social stability,economic development and people’s life and property security.
