Criminal Regulation of GM Foods

转基因食品自其问世之日起就在世界各国引发持续争议,其解决世界粮食危机的天使一面和潜在对人体和环境带来巨大危险的魔鬼一面,让各国立法机关在面对它的时候显得无所适从。然而,相关的调查研究已经证实了转基因食品的潜在危害,在风险社会的背景下如何从刑法的角度构建对转基因食品的规制成为亟需解决的问题,对于转基因食品的进出口、研发、生产、流通和销售流程中所参与的监管者、研发者、生产者、运输者和销售者设置相应的刑法措施或是可行之道。

GM foods have been in great controversy since its birth.The conflict between its role in solving food crises and the potential dangers to human body and the environment makes every legislature pause and ponder.Now that researches have confirmed the possible dangers,it is urgent to make criminal regulations in regard to GM foods.It is argued that an effective way is to regulate with criminal acts the supervisors,designers,manufacturers,transport companies and distributors involved in the import and export,research and development,production,circulation and sale of GM foods.
