我们不仅需要秩序,更需要法治下的秩序,特别是到了社会深度转型时期。这不仅是对当代中国建设社会市场经济体制的积极应对,更是对中国千年统制形态的反思。站在法律规范形成的过程与法前社会秩序形成的立场,重读"活法",充分研究本土"活法"资源,以民族"活法"为基础,构建我们自己民族的法律体系应为法治建设之上举。

We need not only order but also the rule of law,especially at the time of deep society transferring.We should repeat 'live law' on the background of the social order with law and no law.Perhaps,it is the better choice that we build our national the law system on the base of our 'live law' after we study local resource of 'live law'.
