论清末大陆法系检察制度之引进

我国古代没有检察制度,近代意义上的检察制度随着清末司法改革才得以引进中国。现代意义上的检察制度发轫于欧洲大陆,它们在各自的发展中都吸收了本国关于法律监督的传统,分别形成了大陆法系的检察制度和英美法系的检察制度。通过对近代检察制度引进过程的梳理,有利于我们加深对近代检察理论的理解,当然对于今天检察制度理论的构建也不无裨益。
