中国古代的笞杖刑罚体现着严刑峻罚的思想,从历史文化传统的角度分析,法家文化的"重刑"主义、君主专制主义,儒家文化的"礼治"思想、"三纲五常"以及秦汉以来的文化专制主义流毒都对笞杖刑罚产生了极大的影响;从世俗民心的角度分析,家法族规、学府规训等民间笞杖责罚则对笞杖上升为刑罚起到了推波助澜的作用,笞杖下的权力意识、变态心理则更是促使了笞杖刑罚的根本扭曲。

Chinese ancient punishments of whipping and flogging reflect an idea of strict punishment.From the respect of historical and cultural tradition,doctrine of severe punishment and autocratic monarchy of Legalist school culture,'rule by ceremony'and 'principle of feudal moral conduct' of the Confucian culture and pernicious influence of cultural autocracy from Qin and Han Dynasties have extremely influenced punishments of whipping and flogging.From the respect of common customs and popular psychology,whipping and flogging in rules of family and regulations of school have contributed a lot to becoming criminal penalty,what's more,power consciousness and aberrant psychology under whipping and flogging have contributed even more to the distortion of punishments of whipping and flogging.
