通过梳理作为刑法帝王原则的罪刑法定实现的方法论变迁过程,由机械适用法律到法律解释再到法律论证后,结合理论界关于法律概念的类型化以及法律适用归类思维的研究视角,进一步探讨了罪刑法定的司法实现过程。在此基础之上,立足于我国后法型法治国家的现状,指出了我国罪刑法定实现的路径选择。

By analyzing the criminal law as the principle of a legally prescribed punishment for a king to realize the methodology of the change process,from mechanical applicable law to legal interpretation to legal argumentation,the combination of scientific theory about legal concept of stereotype and legal application classification thinking research angle of view,further discusses the legally prescribed punishment for a judicial process.On this basis,based on our country method type a country under the rule of law in our country,and points out that the present situation of the realization of a legally prescribed punishment for a route choice.
