随着社会群体法律意识的觉醒,民事诉讼已经成为公民维护合法权益和解决争议的重要手段之一。但近年来频繁出现的虚假诉讼却使诉讼——这一"正义化"象征蒙上了一层阴影。应当以分析虚假诉讼的定义、构成要件、特征、主要类型、成因、规制必要性为着眼点,以及从检察监督视角对虚假诉讼进行有效监督。

Along with the awareness of the legal consciousness of the social groups,civil lawsuit has become one of the important means that citizens safeguard their lawful rights and interests and resolute disputes.But in recent years,frequent false lawsuit made lawsuit —— a symbol of 'justice' be covered with a shadow.This paper mainly analyzes the false lawsuit from the definition,components,characteristics,main types,causes,necessary regulation,as well as supervision from the perspective of the procuratorial and how to carry out the effective supervision of false lawsuit.
