建设工程承包人优先受偿权之功能研究

A Functional Analysis of PRC Contract Law Article 286

《合同法》第286条旨在解决工程款拖欠问题,促进对建筑工人的保护。自成立以来,学界对其性质、适用议论颇多,而最高人民法院又专门颁布司法解释,指导审判实践。不过,实务界对此仍有诸多问题,理论界亦未能令人信服地说明承包人优先权的存在理由。本文试图运用系统研究与成本—效益研究的方法,分析承包人优先权之实际功能与潜在功能,并以此为基础提出改进此项制度的建议。

PRC Contract Law Article 286 is purported to deal with the huge a- mount of construction prices in default,and thereby,to lend support to construction workers in collecting their compensations.Disputes arose,soon after it came into being,about the nature of the right created by this article in the academic circle. The PRC Supreme Court laid down several judicial interpretations,serving as guide- lines to its adjudications.In practice,however,problems are yet to be cleared off for its application.Commentators,on the other hand,have not so far convincingly enumerated the rationales for providing such a favorable protection to construction contractors.In this article,I tried to investigate the actual functioning as well as po- tential functions of the contractor's priority right,with a systems approach and cost- benefit studies.On the basis of these investigations,this article also made recom- mendations for amending the current law.
