Dong Kang and Legislation of Modern China

董康是中国近代法制史上的一位重要人物。无论是清末修律时宪法、民法、刑法、民刑诉讼法的修订,还是北洋政府时期的两次刑法修正案,董康都参与其中并起到了重要的作用。在这些立法活动和后来对南京国民政府民刑立法的评论中,董康既注重民情又重视世界先进法理的立法思想得到了集中体现。

Dong Kang is an important figure in China's modern legal history.He played an important role in legislating of both Constitution,Civil Law,Criminal Law,Civil and Criminal Procedure Law in End of Qing Dynasty and two amendments to the Penal Code in the BeiYang government period.These legislative activities and the later comments on Civil and Criminal Legislation of the National Government demonstrated Dong Kang' legal thought clearly,which pays attention not only to public sentiment,but also to the advanced ideals of jurisprudence of legislation.
