对法律进行经济分析并不是现代西方法经济学者的专利。马克思就运用经济学的概念和方法来对法律进行分析。马克思最初对法律进行经济分析,是在《1844年经济学哲学手稿》之中。历史唯物主义的创立,则标志着马克思经济分析法学的产生。马克思经济分析法学的基本内容可以概括为:从经济角度看法律,对法律现象进行经济分析,探寻隐藏在法律背后的经济逻辑;从法律角度看经济,对经济现象进行法律分析,揭示经济现象背后的法律逻辑。马克思的经济分析方法在《资本论》及其手稿中得到了充分的体现。

Economists and jurists of modern Law and Economics are not the only scholars to analyze law in economic approach.Karl Marx also applied the conceptions and methods to study laws.He first did this in his Economic Manuscript (1844) .The foundation of historical materialism means Marx's economic analyze on law coming into being.We can describe it like this.studying and analyzing law from the perspective of economics to seek the economic logic lying in law;studying and analyzing economy from the perspective of law to seek the law logic in economy.Marx's economic approach to law was embodied in his On Capital and its manuscript.
