国际法治视野内的习惯国际人道法被引量：4

摘要国际社会武装冲突的实际存在使得对于武装冲突进行规范变得必要,国际社会的法治化则使得此种规范变为可能。红十字国际委员会经过努力在国际人道法编纂方面取得了重要的成绩,出版的报告《习惯国际人道法》获得了广泛关注。但是,此报告的内容是否可以归为习惯、能否落实为法律责任,颇值得怀疑;同时报告中也存在着"重述"和"发展"的难题。而且习惯国际人道法真正起到作用,尚有待于国际法治的强化。
