中国少数民族传统医药保护的立法模式思考

Consideration to the Legislative Model of Protecting Ethnic Traditional Medicament

中国少数民族传统医药保护的现行立法主要采取多层次、多部门的综合性法律保护模式,制度设计上有多宏观、少具体、欠针对性和欠可操作性的特点,保护方法上有突出的重公法保护而轻私法保护的倾向。因而,少数民族传统医药保护在法律层次上应采取相对集中独立的立法模式。

The present legislation of protecting Chinese ethnic traditional medicament mainly takes a comprehensive protection way of multi-layers and multisectors cooperation.It has the character with more macroscopical and less concrete way,which lacks of pertinence and maneuverability.It has the tendency of stressing the public law while neglecting private law.Therefore,the legislative model of protecting Chinese Ethnic traditional medicament should be the model of relatively centralizing and independent legislation.
