防治乡镇企业污染环境立法探讨

Approach to Legislation of Prevention and Control of Township Enterprises' Enviromental Pollution

由于乡镇企业生产中的污染失控和市场经济的负面效应、污染转嫁、缺乏完备的立法和严格的执法等原因 ,乡镇企业对生态环境的负面影响日益突出。但是现行法缺乏体系化和严密化 ,部分内容滞后 ,可操作性不强。为此 ,应出台乡镇企业污染防治配套法 ,加强地方立法及环境执法的监督立法 ,并且制定《乡镇企业污染防治条例》。

Because of the negative effects of market economy,the uncontrolable pollution during the township enterprises' production.pollution shift unperfect legislation and slack law enforcement,the negative effects of township enterprises' pollution become more and more ordstanding.However,law in effect lacks systematize and rigorousness,and part of the regulations is impractical and out of date.Therefore,the legislature showld enact laws relating to prevention and control over township enterprises' pollution,and strengthen legislation of rigional laws and rules supervising the enviromantal laws enforcement.Moreover,Rules of Prevention and Control of Pollution of Township Enterprises should be legislated.
