为确保民事诉讼的顺利进行 ,民事诉讼法规定了对妨害民事诉讼的强制措施 ,其实质应是民事诉讼法律责任。因而应进一步深化对民事诉讼法律责任概念的认识 ,并对民事诉讼强制措施和民事诉讼法律责任做出严格区分 ,在此基础上阐明确立民事诉讼法律责任的主张及理由。

Intending to secure the civil procedure's being carried out smoothly, the civil procedure law ordains the compulsory measure of civil action, which in essence should be the legal liability of civil action;therefore it is necessary to deepen the understanding of the definition of the legal liability of civil action, and the difference of the compulsory measure of civil action and the legal liability of civil action must be distinguished strictly, upon which the view and the causes for clarifying the legal liability of civil action is to be expressed.
