西方法治的文化社会学解释框架

法治概念的完整图景是随着历史的推展而逐渐清晰化的 ;宗教与经济、教皇与商人 ,对近代西方法律体制的形成有同样的重要性与塑造力 ;对法治进步的评价 ,须参照多元文化的知识框架 ,未来的法治话语中也必然会包含有非西方知识的内容 ,这不是纯粹意志的妥协 ,而是文明 文化生态平衡的结果 ;法治制度所型塑的“人”的形象 ,绝对不是一幅完美的图像 ,但它维系着人类生活、社会构成以及文化延续力乃至整个社会个体生存的基础 ,至少对世俗的世界和人类还是必须的。

The complete prospect of the concepts of rule of law is getting clear with the stretch of history. Religion and economy, pope and businessman have the same important function and shaping force to the formation of the legal system in the recent Western history. The remarks on the progress of rule of law need to take the knowledge frame work of multi-culture for reference. The words used in the future rule of law will certainly contain the subject of non-western knowledge. This is not a compromise of pure willpower, but civilization - the result of cultural ecological balance. The image of 'people' shaped by the system of rule of law is absolutely not a perfect picture, but it maintains human life, social constitution, cultural continuity, and even the foundation for the individual existence of the whole society. It is at least necessary for the earthly world and human being.
