世纪之交中国国际私法立法回顾与展望

中国现行的国际私法根植于计划经济的土壤 ,与时代的要求和我国改革开放的要求相距甚远。在世纪之交及中国即将加入WTO之际 ,中国国际私法的变革面临历史性机遇。鉴于中国国际私法的特点 ,及其存在的种种弊端 ,中国国际私法的立法亟待完善。

China's current private international law is rooted in the soil of outmoded planned economy. It is widely divergent from the requirements of the new era and the open-door policy. On the occasion of the intersection of the centuries and China' entry into WTO, the reformation of China's private international law is faced with historical opportunities. In view of the legal characteristics of China's private international law and its various shortcomings,the perfection of its legislation is in urgent need.
