限制与保障:病患自主权行使之探究

Limit and Guarantee: The Research on The Exercise of The Patient's Autonomy Right

尊重病患自主是近代医学伦理中一个重要的原则。但在实际医疗诊治中,该权利行使又会受到一系列的限制,如病患本身的原因、传统的医疗父权及我国特有的家属父权影响等。因此,有必要通过引入"成熟的未成年人"理论、对家属的权利加以合理限制等措施对病患自主权的行使加以保障。

Respecting the autonomy of patient is an important principle in modern medical ethics.While the exercise of this right would also be limited by a series of restrictions in the actual medical treatment process,such as the cause of the patients,the traditional patriarchy of doctor and the unique patriarchal of families in our country and so on.So it is necessary to ensure the exercise of the right of patient'autonomy through introducing the theory of 'mature minors',limiting the rights of family rationally,etc.
