在司法实践中正确理解、运用刑法学上的打击错误理论有利于正确对被告人定罪量刑,防止放纵犯罪现象的出现。打击错误不同于手段错误、认识错误和因果关系错误。打击错误在学理上主要有两种观点,即具体符合说和法定符合说。在司法实践中法定符合说更加具有合理性,更符合罪责刑相一致的原则。

That understanding and applying the theory of combat error correctly in judicial practice, is beneficial to correct conviction and sentence, and preventing the emergence of the phenomenon of the indulgence of crime. Combat error is different from method error, recognizing error and causality error. There are mainly two kinds of theories on the combat error, which are theory of statutory conformation and theory of concrete conformation. Theory of statutory conformation is more reasonable and more consistent with the principle of compatibility of crime, responsibility and penalty in judicial practice.
