行政执法与刑事司法衔接之证据转化机制研究

The Transformation Mechanism of Evidence of Linkage between Administrative Enforcement and Criminal Justice

行政执法与刑事司法衔接之关键点就在于证据的转化,我国新《刑事诉讼法》第52条第二款对此做了规定,但这仅限于原则性的规定,对于转化主体、转化范围、转化方式、转化监督等并没有作出规定,给司法机关的办案带来很大的困难和障碍。为了使该制度在司法实践中更具有可操作性,我国有必要制定一系列统一的转化机制和制度来对此进行规范。

The key linking point of administrative law enforcement and criminal justice is the transformation of the evidence. The second paragraph of Article 52 of the new Code of Criminal Procedure makes provision for this,but this is just the provisions of the principle,did not make regulations for the transformation of the body,the conversion range,transformation methods,transformation supervision,so it brought great difficulties and obstacles for the judiciary in handling cases. In order to make the judicial system more workable in practice,we need to develop a series of uniform transformation mechanism and systems to regulate this.
