探析职务犯罪初查监督机制的完善

Discussion on the Improvement of the Supervision Mechanism in the Duty Crime Preliminary Investigation

目前职务犯罪初查监督机制主要分为内部监督机制和外部监督机制两种,其中内部监督机制主要包括同级检察机关的横向监督、上级检察机关的纵向监督以及职务犯罪侦查部门自身监督,而外部监督则主要包括人民监督员监督、实名举报人和控告人监督。职务犯罪初查监督价值的缺陷主要表现为:重实体监督、轻程序监督,重静态监督、轻动态监督,重柔性监督、轻刚性监督,重内部监督、轻外部监督。因此,进一步完善职务犯罪初查监督机制需要逐步实现程序监督跟进,加大动态监督力度,增强刚性监督力量,完善外部监督机制。

At present,the internal supervision mechanism of duty crime preliminary investigation mainly includes procuratorial organs at the same level of horizontal supervision,the superior procuratorial organs' supervision,and supervision from duty crime investigation department. While its external supervision mainly includes the people's supervisor supervise,the real-name whistleblower's supervision and the accused person's supervision. The duty crime preliminary investigation supervision mechanism has defects such as it always attaches great importance to the entity supervision,while despising procedure supervision. Therefore,In order to improve the duty crime preliminary investigation supervision mechanism,we need to improve the process supervision,the dynamic supervision,the rigid supervision and the external supervision.
