韩国内陆及济州岛地区分家习惯法之评鉴

The Research on the Family Division Customary Law in Inland and Jeju Island Area of South Korea

韩国是单一民族国家,分家习惯的地方性差异没有中国这样复杂。但由于地理位置上的原因,韩国济州岛的分家习惯与韩国内陆地区有着很大的差异。其差异性源自于济州岛特殊的自然条件、特有的生产形态及岛民的性格。可以通过对韩国内陆地区和济州岛地区的分家习惯的研究评述,从比较研究的角度,结合我国当前分家习惯的现况,可以探索我国分家习惯未来发展的平衡点。

South Korea is a nation-state,Regional differences of the family division custom in South Korea is less diverse than Chinese. Due to the geographical location,the custom of the family division in both South Korea inland and Jeju Island area has a large diversity. Reasons include the special natural conditions,the unique form of production,and the character of the islanders. With a comparative study,the authors provide a perspective on the innovation trends in Chinese family division custom.
